Vanwelzenis said he and another officer then approached Luloff to “conduct an investigation,” where he noticed the smell of alcohol while speaking with the councillor. Vanwelzenis then administered a breath test, which Luloff failed. The officer then arrested and charged the councillor with impaired driving, but told the court he forgot to read out a standard demand for a breathalyzer technician to take another sample before taking Luloff to the cell block on Elgin Street. However, that demand was read at the cell block, the officer said.
