This breached Section 10 of the Charter of Rights and Freedoms, Greenspon added, which guarantees that everyone has the right, upon detention or arrest, to be properly informed of the reasons immediately after. It also guarantees rights to those accused of crimes to retain counsel and to be informed of that right and to be released if the detention is not lawful.
